We at Dasatoo, Inc. (“Dasatoo”, “we”, “us”) respect your privacy and want you to understand how we collect, use, and share data about you. This Privacy Policy covers our data collection practices and describes your rights to access, correct, or restrict our use of your personal data.

This Privacy Policy applies to the Dasatoo website which includes media managed by Dasatoo, Inc., and the online course creation platform that enables independent instructors (“Instructors”) to deliver live and recorded instruction, digital goods, and learning services as massive open online courses (“Courses”) to end-users (“Students”). Our website, online course creation platform and related services are hereinafter collectively referred to as our "Services".

By using the Services, you agree to the terms of this Privacy Policy. You shouldn’t use the Services if you don’t agree with this Privacy Policy or any other agreement that governs your use of the Services.


We collect certain data from you directly, like information you enter yourself, data about your participation in courses, and data from third-party platforms you connect with Dasatoo. We also collect some data automatically, like information about your device and what parts of our Services you interact with or spend time using.


To use Dasatoo’s facilities, you should create an account. During registration, we collect Personally identifiable information associated with you. In particular we may obtain a first and last name, a home or other physical address, including street name and name of a city or town, a ZIP code, billing or mailing address, credit/debit card information a telephone number, an e-mail, a Government issued identification document, Social Security number, a Gender, date of birth, any other identifier that permits the operator to make a physical or online contact with individuals.


For the purpose of billing courses fees we may request your credit card, bank account and certain contact information, such as a billing address. We retain credit card information internally for the purpose of all payment processing related to our Services.  This includes the use of your payment information to allow you to purchase courses through your Dasatoo account. The payment information is necessary in order for you to participate in paid course and failure to provide such information may result in you not being able to use our Services. Payments processed via Custom Payment Gateway third party like Stripe are subject to   the terms of use and privacy policies of those payment gateways and are not accessible or controlled by Dasatoo.  For payments processed via Dasatoo and Custom Payment Gateway, we receive information related to the payment status of your account; this information includes your payment card type and last four digits, postal code, country of origin, payment expiration date, and any email address associated with the payment type. When you enroll in or create courses, you may provide specified information. This will enable both Tutors and Students to learn more about each other. Correspondingly, we collect additional data from the:

  • Tutors, such as educational background, language skills, work experience. Additional information may help you to get more from the Services, for instance, finding students.
  • Students, such as preferences, attended colleges or universities. Additional information may help you to get more from the Services, for instance, finding a necessary tutor.

At the same time you are not required to provide additional information, not specifically necessary for the registration, it is your choice.


You can also do social networking on Dasatoo platform. You can create discussion boards, where participants can respond to the discussions they’re interested in, chat and communicate with one another, share and/or upload photos, videos, just to name a few. Consequently we gather data including information or content you provide (like metadata), such as the location of a photo or the date a file was created. We collect information about the people, accounts, hashtags, uploaded photos or videos and data you shared in your page. You are responsible for the posts and information you provide by posting it on your wall or in any other way making it public. Therefore, you should think carefully about what you make public, especially if it is sensitive information. When you update you public information, we will reflect your updated content on Dasatoo.com.


We obtain usage statistics about your interactions with the Services, including courses accessed, time spent on pages or the Service, pages visited, features used, your search queries, click data, date and time, and other data regarding your use of the Services.

 

Technical data are collected about your computer or device, like your IP address, device type, operating system type, and version, unique device identifiers, browser, browser language, domain, and other systems data, and platform types.

 

An approximate geographic location, including information like country, city, and geographic coordinates, calculated based on your IP address.

 

If you contact us for support or to report a problem or concern, we collect and store your contact information, messages, and other data about you like your name, email address, location, operating system, IP address, and any other data you provide or that we collect through automated means. We use this data to respond to you and research your question or concern, in accordance with this Privacy Policy.

 

All those data are obtained through the use of cookies, HTML5, and other similar technologies.


A cookie is a small piece of data that is stored on your computer or mobile device. Like many websites, we use cookies and similar technologies to collect additional website usage data and to operate our services. Cookies are not required for many parts of our services such as searching and looking at public profiles. Although most web browsers automatically accept cookies, many browsers’ settings can be set to decline cookies or alert you when a website is attempting to place a cookie on your computer (You can change cookie settings in your web browser). However, some of our services may not function properly if you disable cookies. When your browser or device allows it, we use both session cookies and persistent cookies to better understand how you interact with our services, to monitor aggregate usage patterns, and to personalize and otherwise operate our services such as by providing account security, personalizing the content we show you including ads, and remembering your language preferences. We use your data to do things like provide our Services, communicate with you, troubleshoot issues, secure against fraud and abuse, improve and update our Services, analyze how people use our Services, serve personalized advertising, and to fulfill our obligations under Terms of Service for Services provision. Specifically, we use your personal data upon registration to help others (be it a tutor or a student) to find your account or profile.

 

We will use your personal information in accordance with applicable data protection legislation and this Privacy Policy for the following purposes:

  • To provide and administer the Services, including to show customized content and facilitate communication with other users;
  • Process your requests and orders for courses, products, specific services, information, or features;
  • Stay in contact with you about your account by:
    • Responding to your questions and concerns;
    • Sending you administrative messages and information, including messages from tutors and teaching assistants, notifications about changes to our Service, and updates to our agreements;
    • Sending you information about your progress in courses, rewards programs, new services, new features, promotions, newsletters, and other available courses;
    • Sending push notifications to your wireless device to provide updates and other relevant messages (which you can manage from the “options” or “settings” page of the mobile app);
  • Manage your account preferences;
  • Facilitate the Services’ technical functioning, including troubleshooting and resolving issues, securing the Services, and preventing fraud and abuse;
  • Solicit feedback from users;
  • Market and administer surveys and promotions administered or sponsored by Dasatoo;
  • Learn more about you by linking your data with additional data through third-party data providers or analyzing the data with the help of analytics service providers;
  • Identify unique users across devices;
  • Improve our Services and develop new products, services, and features;
  • As required or permitted by law; or
  • As we, in our sole discretion, otherwise determine to be necessary to ensure the safety or integrity of our users, employees, third parties, the public, or our Services.

As mentioned above, we share data that we have about you with tutors for courses you enroll in or request information about, so they can improve their courses for you and other students.


Depending on your settings, your shared content and profile data may be publicly viewable, including to other students and instructors.


For the purpose of administering payments within our Services, we may disclose your Personal information to third party payment provider and your bank.


We may disclose your data to third parties if we (in our sole discretion) have a good faith belief that the disclosure is:

  • Permitted or required by law;
  • Requested as part of a judicial, governmental, or legal inquiry, order, or proceeding;
  • Reasonably necessary as part of a valid subpoena, warrant, or other legally-valid request;
  • Reasonably necessary to enforce our Terms of Use, Privacy Policy, and other legal agreements;
  • Required to detect, prevent, or address fraud, abuse, misuse, potential violations of law (or rule or regulation), or security or technical issues; or
  • Reasonably necessary in our discretion to protect against imminent harm to the rights, property, or safety of Dasatoo, our users, employees, members of the public, or our Services;
  • We may also disclose data about you to our auditors and legal advisors in order to assess our disclosure obligations and rights under this Privacy Policy.

If Dasatoo undergoes a business transaction like a merger, acquisition, corporate divestiture, or dissolution (including bankruptcy), or a sale of all or some of its assets, we may share, disclose, or transfer all of your data to the successor organization during such transition or in contemplation of a transition (including during due diligence).


We can disclose or use aggregate or de-identified data for any purpose.


With your consent, we may share data to third parties outside the scope of this Privacy Policy.


We share certain data about you with tutors, other students, companies performing services for us, including payment processor and our business partners. We may also share your data as needed for security, legal compliance, or as part of a corporate restructuring. Lastly, we may share data in other ways if it is aggregated or de-identified or if we get your consent.

 

We may share your data with third parties under the following circumstances or as otherwise described in this Privacy Policy:


Personal data will not be stored longer than necessary for the purposes for which the personal data is processed. Please note that personal data may be stored for longer periods if required by applicable law or necessary to resolve disputes or to enforce our agreements. Information that we use for marketing purposes will be kept with us until you notify us that you no longer wish to receive this information.


We use proper security based on the type and sensitivity of data being stored. As with any internet-enabled system, there is always a risk of unauthorized access, so it’s important to protect your password and to contact us if you suspect any unauthorized access to your account.

 

Dasatoo takes proper security steps to protect against unauthorized access, alteration, disclosure, or destruction of your personal data that we collect and store. Those steps are divers based on sort of data. At the same time, we cannot warrant that communication between you and Dasatoo, the Services, or any information provided to us in connection with the data we collect through the Services will be free from unauthorized access by third parties. Your password is an important part of our security system, and it is your responsibility to protect it. You should not share your password with any third party, and if you believe your password or account has been compromised, you should change it immediately and contact legal@dasatoo.com with any concerns.


You have the right to request Dasatoo, Inc. for copies of your personal data.

Users have the right to request that Dasatoo, inc disclose certain information to them about our collection and use of their personal information over the past 12 months. Dasatoo gives you measures to be informed about:

  • The categories of personal information we have collected about you.
  • The categories of sources from which the information is collected.
  • The categories of third parties with whom we share the information, including recipients in third countries or international organizations.
  • The specific pieces of personal information we collected about you.

 

Please note that we may provide personal information to a consumer not more than twice in a 12-month period.

Downloading your information is a password-protected process that only you will have access to. Once your copy has been created, it will be available for download for a few days.

 

We have also means that allow you to correct, modify, or update your data.  You can do it directly through your account settings.

You have the right to request that Dasatoo Inc. delete any of your personal information that we collected from you and retained, subject to certain exceptions. To erase your data you may deactivate your account. For up to 30 days after deactivation, it is still possible to reset your Dasatoo account.

 

However, we may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Remember that search engines and other third parties may still retain copies of your public information, like your public posts, even after you have deleted the information from our services or deactivated your account (For example Google use many factors to generate search results, like the content of a public post and Dasatoo profiles, or blogs and other websites that link to posts or your Dasatoo profile). Dasatoo does not control search results on third party search engines.


We will not discriminate against you for exercising any of your rights. Unless permitted by the law, we will not:

  • Deny your goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.


You have the right to request that Dasatoo restricts the processing of your personal data under certain conditions. For example, if you contest the accuracy of the personal data, the processing may be restricted for a period enabling Dasatoo to verify the accuracy of the data or if Dasatoo no longer needs the data for the purposes of the processing but you require the data for the establishment, exercise, or defense of legal claims.


You have the right to object, on grounds relating to your particular situation, at any time to Dasatoo's processing of your personal data if the processing is based on, for example, legitimate interests. If you object to such processing, Dasatoo will no longer be entitled to process your personal data based on such legal basis, unless Dasatoo can demonstrate compelling legitimate grounds for the processing which overrides your interests, rights, and freedom or if it is conducted for the establishment, exercise, or defense of a legal claim.


You have the right to request that Dasatoo, Inc. transfer the data that we have collected to another organization, or directly to you, under certain conditions.

Under CCPA and GDPR, the users have also the right “to opt-out” by which they prevent selling their personal information.

According to law, the Privacy policy will be updated every year. It is highly recommended to check it at the beginning of each year to be informed of those changes. However, we will send you a notification or will post a viewable announcement in Dasatoo.


Users under 13 are able to create a Dasatoo account and participate in courses only under COPPA requirements. Please read our “Children’s Privacy Protection” to learn more about our policy regarding Children’s data collection, use, and parental rights.


If any personal data of yours would be under the breach, we would inform you and the respective data protection agencies as to the accidents without undue delay, if there are high risks of violation of your rights as the data subject. We would also do our best to minimize any such risks.


Dasatoo does not currently recognize or respond to browser-initiated Do Not Track signals.


In order to find the points of interest in our Services and for the purposes of analytics, we monitor and analyze web traffic and keep track of your behavior within our Services. This enables us to provide services that are relevant to you and boost the quality of our Services. The data concerned within this activity are Cookies and Usage data, such as the parts of our Services you visit, the date and duration of your visit, and the type of the device you used during your visit. All your data stated in this paragraph is collected and further processed in a manner that does not allow your identification. For these purposes, we use Google Analytics the use of which ensures compliance with our privacy commitments.


In case you are a resident of California, the California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal data by Dasatoo, Inc. or its subsidiaries to a third party for the third party's direct marketing purposes. This Privacy Policy is governed by and construed with the laws of the State of Delaware, USA, and, when applicable, Regulation 2016/679 on the protection of natural persons with regard to the processing of Personal Data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”), effective as of 25 May 2018.
